If you have a DUI on your record you may be able to get it erased, or expunged. Utah Code 77-18-12 provides for the expungement of a DUI if certain conditions have been met, and with approval of the court. If you have a misdemeanor DUI, you must wait ten years from the time you completed probation for your DUI offense — including payment of all fines. Thereafter, a petition can be filed with the court seeking expungement.

Felony Expungement

Although Utah law does not allow for the expungement of a felony DUI, I can file a motion on your behalf — called a 402(b) motion — that could reduce a felony DUI to a misdemeanor DUI. As with any legal case, the results vary depending on the facts of your case and the ruling of the individual judge that presides over your case. Reducing your DUI from a felony to a misdemeanor could increase your employment opportunities significantly.
