- Second DUI: The criminal and civil penalties for a second DUI are significantly greater than those for a first DUI. A second DUI conviction results in a mandatory minimum jail sentence of 10 days. Judges have the power to substitute community service or house arrest, but often choose to impose the 10 day sentence if they are not strongly persuaded to show leniency. An experienced attorney is essential to protect your rights.
- Felony DUI: A third DUI conviction in 10 years is a third degree felony — punishable by up to five years in prison. Any DUI, even a first DUI, that resulting in serious bodily injury may also be charged as a felony. I have the experience necessary to defend your rights if you have been charged with felony DUI.
- DUI metabolite/drugs: If you have any remnants of an illegal drug in your system, you could be convicted of a DUI metabolite offense — even if you took the drug several days prior to driving.
- Underage DUI: Utah has extremely strict laws designed to prevent incidents of underage drinking and driving. For a first DUI conviction, a driver under 21 could face a driver's license suspension of 120 days, or until the age of 21 — whichever is longer. - Driver's license suspension hearings: A Utah driver convicted of a first time DUI may have their driver's license suspended for 120 days. I represent clients at DUI driver's license suspension hearings.
